TITLE
Recommendation to authorize City Manager to execute a permit with Pacific Sailing, Inc., for the use of docks, slips and end ties for the operation of a sailboat charter service at Rainbow Harbor Marina, for a three-year term ending November 30, 2011, with one two-year renewal option.  (District 2)
 
DISCUSSION
Pacific Sailing, Inc. (Pacific Sailing), has been operating in the City of Long Beach since 1988, under various owners. The new owner/operator, Mike Nelson, is requesting a permit to operate the Pacific Sailing Club and Academy of Seamanship, a sailboat charter service open to the general public (Exhibit A). Pacific Sailing is an accredited American Sailing Association (ASA) instruction facility offering courses designed by both the United States Power Squadron and the U.S. Coast Guard Auxiliary to meet the National Association of State Boating Law Administrators requirements for certification.  Individuals will learn the fundamentals of safe boat handling, operation, and basic piloting. In addition to offering both basic and advanced courses, Pacific Sailing offers private lessons, ASA Sail Training Certification, skippered charters, boat owner and racing programs, and sponsors various social events. Pacific Sailing operates year-round from 9:00 a.m. to 5:00 p.m., seven days a week, with extended hours during the summer season (8:00 a.m. to 8:00 p.m.). The service will significantly increase water safety awareness, while providing year-round recreational boating and educational opportunities to local residents.
 
The following are the major provisions of the proposed permit:
 
· Premises: Commercial dock space, as assigned by the Marine Bureau.
 
· Authorized Use: Operation of a sailboat charter concession and sailing/boating club.
 
· Term: Three years, through November 30, 2011.
 
· Renewal Options: One, two-year renewal option, subject to the discretion of the City Manager or designee.
 
· Permit Fee: Six percent annual gross receipts for the first and second year and seven percent annual gross receipts for the third year, with an annual minimum of $5,000.
 
· Dock Fee: $14.50 per lineal foot occupied or reserved by the operator, or other fee subsequently adopted by the City Council.
 
· Insurance: Pacific Sailing Inc. shall provide insurance coverage as defined by the City's Risk Management Office.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on June 11,2008, and by Budget Management Officer Victoria Bell on June 13, 2008.
 
TIMING CONSIDERATIONS
City Council action is requested on July 8, 2008, to enable the execution of the permit.
 
FISCAL IMPACT
Annual revenue in the amount of $5,000 will accrue to the Tidelands Fund (TF) in the Department of Parks, Recreation and Marine (PRM).
