TITLE

DISCUSSION
Nguyen -- This case involves a traffic accident which occurred on November 6, 2006 on 7th Street. The Plaintiff, a 22 year-old student with polio, was stopped for a red light when she was struck from behind by a refuse truck that was unable to stop in time. The force of the impact caused damage to the wheelchair and wheelchair lift that was attached to the trunk of her car. The impact also caused a total loss of her vehicle.

Plaintiff complained of pain to her spine and soft tissue injuries. She incurred a total of $7,690 in medical specials and $11,185 for property damage of the wheelchair, wheelchair rack and vehicle.

After negotiations, the parties tentatively agreed to a full and complete settlement, inclusive of all costs and fees in the amount of $17,500.

The proposed settlement was presented to the Economic Development and Finance Committee on April 1, 2008 and was approved on that date. We therefore ask authority to pay the sum of $17,500 in full settlement of this claim against the City of Long Beach.

Verizon -- On March 27, 2006, City Water Department employees damaged two Verizon telephone cables while installing a new water pipe across 5th Street. They used a drilling device to bore a hole for the pipe and the device hit the two cables. City consultants reviewed Verizon’s claim for labor, materials and administrative overhead. After extensive discussion, a tentative settlement of $82,239.74 was reached.
