TITLE
Recommendation to authorize payment in the amount of $159,968 to Diversified Developers Realty Corporation (DDR) for the traffic signal improvement at 4th Street and Long Beach Boulevard.  (District 1)

DISCUSSION
In early 2003, in connection with the City Place development, a traffic signal was to be installed at 4th Street and Long Beach Boulevard. City forces were to have installed this signal, however, DDR was at the time in the process of constructing associated street work in the area and the City requested that DDR proceed at City expense with the construction of the signal. Staff has reviewed DDR's costs and determined they are reasonable.

The City Council is being requested at this time to authorize payment. The requested signal work was included in the Traffic Mitigation Program (TMP) in the 2002 TMP Report approved by the Council and is therefore fully funded at this time.

This matter was reviewed by Amy Burton, Deputy City Attorney on March 19,2008 and by Budget Management Officer Victoria Bell on March 31,2008.

TIMING CONSIDERATIONS
City Council action on this matter is requested on April 15, 2008, to allow expeditious processing of the change order and payment.

FISCAL IMPACT
Sufficient funding is budgeted in the Traffic Mitigation Program in the Capital Improvement Fund (CP 201) in the Department of Public Works. There is no impact to the General Fund.

SUGGESTED ACTION
Approve recommendation.

Respectfully Submitted,
