TITLE
Recommendation to authorize City Manager to execute a first amendment to Agreement No. 30224 with CJ Tech Construction, Inc., for $85,371; extend the term through completion of repairs of the Bixby Park Band Shell; execute any future documents necessary to complete the reconstruction project; decrease appropriations in the Capital Projects Fund (CP) in the Department of Public Works (PW) by $11,916; and increase appropriations in the Capital Projects Fund (CP) in the Department of Parks, Recreation and Marine (PR) by $11,916. DISCUSSION

On June 5, 2007, the City Council authorized the execution of Agreement No. 30224 with CJ Tech Construction, Inc., for the repair and remodel of the existing band shell structure in Bixby Park, in an amount not to exceed $179,000.

The project includes the following:

· Reconstruction of the northside wing to match the existing westside wing;
· Construction of a new trellis and support columns;
· Repair of the platform corner;
· Repair of the roof;
· Painting of all new and existing exterior woodwork;
· Stripping and painting of all existing decorative window metal grills.

Construction began September 10, 2007. In addition to two change orders, which exhausted contingency funds, the Department of Parks, Recreation and Marine has been requested to modify the project specifications to restore the historic appearance of the roof. Furthermore, the design for the electrical panel was incorrect and requires revision in order to meet Southern California Edison requirements. Implementation of these changes total $85,371.

A project shortfall of $11,916 will be funded using balances from completed projects within the Department of Public Works.

This matter was reviewed by Deputy City Attorney Gary J. Anderson on February 25, 2008, and Budget Management Officer Victoria Bell on February 25, 2008.
