(Citywide)

DISCUSSION
On September 4, 2007, the City Council authorized the City Manager to execute a contract with August Construction, Inc., in an amount not to exceed $790,150. Due to an increase in the amount of Tidelands funds available, staff recommends an increase in the contract to install additional soil anchors at various locations (see attached vicinity map). The contractor, August Construction, Inc., is willing and ready to perform the necessary additional soil anchor installations.

A first amendment to Contract No. 30237 with August Construction, Inc., in the amount of $407,750, is needed to perform the additional soil anchor installations. These soil anchors will replace the existing tie-rods and stabilize the adjoining property. This project has been coordinated with the Naples Island Association.

The original Council approval included a contingency of up to 15 percent above the award amount. With the new contract amount of $1,197,900, the new contingency amount is $179,685, if needed.

This matter was reviewed by Deputy City Attorney Lori A. Conway on December 10, 2007, and by Budget Management Officer Victoria Bell on December 6, 2007. In accordance with the California Environmental Quality Act, Categorical Exemption Number CEP-63-07 has been issued for this project.

TIMING CONSIDERATIONS
City Council action on this matter is requested on December 18, 2007, to ensure that there are no construction delays.
