TITLE
Recommendation to determine that the granting of Facility/Pipeline Permit No. P-234-07, to Pacific Hospital of Long Beach, will not be contrary to the public interest; and authorize City Manager to issue said permit in accordance with Section 15.44.060, Permit-Issuance, of the Long Beach Municipal Code, for the installation of a conduit for fiber optic and cable communications. (Districts 6,7)

DISCUSSION
Pacific Hospital of Long Beach has filed an application for Facility/Pipeline Permit No.
P-234-07, to install a conduit for fiber optic and cable communications to be located in 2yth Street at Pacific Avenue. The communications conduit will connect their medical offices located on the northeast and southwest corners of the intersection of Pacific Avenue and 2yth Street. The route of the proposed conduit is shown on the attached vicinity map.

The Department of Public Works has reviewed the application and found the proposed conduit to be compatible with existing installations and not an obstacle to any street use or any known proposed developments. Traffic control requirements stipulated by the Traffic and Transportation Bureau will be made a part of the special conditions for the excavation permit. Liability insurance is on file and a bond for faithful performance will be processed following City Council authorization of the permit.

In conformance with the California Environmental Quality Act, a statutory exemption for this installation is being processed with the County Clerk.

This matter was reviewed by Deputy City Attorney Lori A. Conway on November 12, 2007, and by Budget Management Officer Victoria Bell on November 21,2007.

TIMING CONSIDERATIONS
City Council action on this matter is not time critical.

FISCAL IMPACT
An estimated annual pipeline permit fee of $166.51 will be deposited to the General Fund (GP 100) in the Department of Public Works (PW).
