TITLE
Recommendation to authorize City Manager to execute a Frequency Reconfiguration Agreement with Nextel of California, Inc., to comply with the Federal Communication Commission’s new rules governing the 800 MHz band. (Citywide)
DISCUSSION
On August 6, 2004, the Federal Communication Commission (FCC) issued a report and order that modified its rules related to radio communications operating in the 800 MHz band. The purpose of the order is to reconfigure the 800 MHz band to minimize harmful interference to radio communications systems sharing the same band. It requires moving government systems to a spectrum lower in the 800 MHz band and moving commercial carriers to the opposite end of the band.
The City of Long Beach and Nextel of California, Inc. (Nextel) are licensed on frequency allocations subject to the reconfiguration, and Nextel has been ordered by the FCC to reimburse the City for the necessary labor to program the new frequency into the existing 69 mobile radios and four base stations deployed at the Long Beach Gas and Oil Department. Nextel has agreed to reimburse the City at an overtime rate so that work can be performed on a weekend to minimize service disruption to Long Beach Gas and Oil.
This matter was reviewed by Deputy City Attorney Gary J. Anderson on October 15, 2007, and by Budget Management Officer Victoria Bell on November 20,2007.
TIMING CONSIDERATIONS
City Council action is requested on December 4, 2007 so that work may commence to address the interference problem.
FISCAL IMPACT
Technology Services estimates the labor cost to reprogram the affected devices would be approximately $13,000. The costs will be incurred in the General Services Fund (IS 385). There is no impact to the General Fund. Nextel of California, Inc. will reimburse the City for the necessary costs to perform the work.
