TITLE
Recommendation to authorize City Attorney to pay the sum of $32,500 in full settlement of lawsuit entitled Ouk vs. City of Long Beach.
DISCUSSION
This case involves several claims by the Plaintiff that his civil rights were violated by Long Beach Police Officers arising out of an arrest for waving a gun which occurred on February 26,2004. When the police arrived, no gun was found on the Plaintiff, although a gun was later found in a warrantless search of his home.
Plaintiff was booked and jailed. The criminal case was subsequently dismissed a few months later. Plaintiff was treated for soft tissue injuries and emotional distress as a result of the arrest.
After negotiations in a mandatory judicial settlement conference, the parties tentatively agreed to a full and complete settlement, inclusive of all costs and fees in the amount of $32,500.00.
The proposed settlement was presented to the Economic Development and Finance Committee on August 14, 2007 and was approved on that date. We therefore ask authority to pay the sum of $32,500.00 in full settlement of this claim against the City of Long Beach.
