TITLE

DISCUSSION
In 1979, the City of Long Beach vacated a portion of 70th Street while reserving a utility easement over the entire area. Various utilities, including a gas line and a street light conduit, remained in place and functioning in the vacated street area. Ernest and Gudelia Marrujo recently purchased the property for the purpose of a residential development and arranged for the rerouting of the public utilities in order to clear the building site. Only an aerial electrical line remains over the easterly 3 feet of the site for which an easement must be reserved.
 
All of the public and private utility departments and agencies have determined and agreed that the public utility easement reserved in 1979 is no longer necessary, except for the easterly 3 feet of the site. The area to be quitclaimed is shown on the attached Exhibit A.
At this time, it is appropriate to quitclaim this easement area to Ernest and Gudelia Marrujo, who hold title to this parcel.
 
In conformance with the California Environmental Quality Act, Categorical Exemption No. CE-07 -202 was issued for this project. This matter was reviewed by Deputy City Attorney Lori A. Conway on August 29,2007.
 
TIMING CONSIDERATIONS
City Council action is requested on September 11,2007, to allow the developer to proceed with construction.
 
FISCAL IMPACT
A quitclaim processing fee of $2,260 was deposited to the General Fund (GP) in the Department of Public Works.
 
SUGGESTED ACTION
Approve recommendation.
