TITLE

DISCUSSION
In 2005, the owners of the restaurant located at 445 East First Street received a permit to occupy an adjacent portion of the sidewalk. They are now requesting that their permit be revised in order to move tables and chairs away from the entrance further east in front of a fixed window bay. This revised permit area will provide a more functional sidewalk dining area, improve access to the restaurant and maintain the needed public sidewalk path.
 
A sketch showing the existing and proposed permit areas, as well as a list of furnishings and accessories to be placed on the sidewalk, are shown on the attached Exhibit A.  Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code which describes temporary uses of public right-of-way.  The width of the sidewalk along First Street is 12 feet. The width of the Linden Avenue sidewalk is 15 feet. A minimum clearance of 5 feet will be maintained between the permit area and the street trees along First Street and a clearance of 8 feet will be maintained along Linden Avenue.
 
This permit request was reviewed and approved by the Long Beach Fire Department on November 30, 2006. The subject permit was prepared by Deputy City Attorney Lori A.
Conway on January 11, 2007.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A permit processing fee of $500.00 was deposited to the General Fund (GP) in the Department of Public Works (PW).
