TITLE
Recommendation to authorize Department of Planning and Building to process a refund in the amount of $14,717 to Lennar Homes in accordance with Long Beach Municipal Code Section 3.48.040.

DISCUSSION
On October 26, 2006, Lennar Homes paid for school fees in the amount of $213,436 for the property located on 200 East Broadway, project number 463814. The applicant was charged based on the wrong square footage and overpaid for the school fees. Therefore, an approval to process a refund in the amount of $14,717 is requested on behalf of Lennar Homes.
The City of Long Beach Municipal Code Section 3.48.040 requires that refunds exceeding $10,000 be approved by the City Attorney and City Council.
This matter was reviewed by Assistant City Attorney Michael Mais on February 14, 2007 and Budget and Performance Management Bureau Manager David Wodynski on February 12,2007.
TIMING CONSIDERATIONS
City Council action on this item is requested on March 6, 2007, to expedite processing of the refund.
FISCAL IMPACT
The refund amount of $14,717 will be refunded from the Department of Planning and Building's Development Services Fund (SR137) where the collected fees were deposited. Therefore, there is no net impact to the General Fund.
