TITLE
Recommendation to authorize City Manager to execute a Memorandum of Understanding between the Orange County Transportation Authority and the City of Long Beach to facilitate negotiations for the relocation of a natural gas transmission line.  (Citywide)
 
DISCUSSION
The City of Long Beach Gas and Oil Department (LBGO) owns a 14-inch natural gas transmission pipeline (line 1228) located in a 6-meter frontage road south of the Interstate 405 (I 405) and State Route-22 (SR 22) interchange between Seal Beach Boulevard and Bolsa Chica Road. The Orange County Transportation Authority (aCTA) is planning to widen SR 22, and therefore will require the relocation of line 1228. aCTA wishes to enter into a Memorandum of Understanding (MOU) with the City to help facilitate negotiations between aCTA and the City.
 
The MOU shall contain the following major terms:
 
·      The City and aCTA agree to relocate line 1228;
 
·      The parties agree to work together on the technical aspects of the relocation of line 1228; and
 
·      The City and aCTA agree to work towards development of a Cooperative Agreement defining specific roles and responsibilities and payment terms between the two parties.
 
This matter was reviewed by Deputy City Attorney Richard Anthony on January 23, 2007 and by Budget and Performance Management Bureau Manager David Wodynski on February 7, 2007.
 
TIMING CONSIDERATIONS
City Council action is requested on February 20, 2007 to authorize commencement of this MOU.
 
FISCAL IMPACT
There is no fiscal impact to this MOU. The fiscal impact will be determined by the terms of the Cooperative Agreement developed through this MOU.

Approve recommendation.
