TITLE
Recommendation to place a Ban on Big Box ordinance on the next available ballot; specifically, May 1, 2007, should a Citywide election occur.

DISCUSSION
Recommendation: Place Ban on Big Box Ordinance on the next available Ballot.

A motion was approved on Tuesday, January 2, 2007 to request the City Attorney to prepare a resolution placing Ordinance No. ORD 06-0040, the Ban on Big Box Superstores, on the ballot for the regularly scheduled election on June 3, 2008.

The cost associated with adding this item to a June 2008 election will be between $400,000 and $1 .1 million, depending upon how many runoff elections result from the April 2008 election.  Adding this item to the April 2008 ballot will cost approximately $400,000.

Adding this item to the May 1, 2007 ballot, assuming a city-wide special election will be occurring, will cost less than $35,000.

Recommended Council Action
If a May 1 St citywide election occurs, approve the aforementioned recommendation for placing on the May 1, 2007 ballot for a vote of the people .

SUGGESTED ACTION
Approve recommendation.

Respectfully Submitted,

Suja Lowenthal, Councilmember, Second District
Gary DeLong, Councilmember, Third District
