TITLE
Recommendation to request City Attorney to prepare an amendment to the Long Beach Municipal Code Section 10.54.040 - Skateboarding, to prohibit skateboarding on Long Beach Community College District campuses and Long Beach Unified School District facilities.  (Citywide)
 
DISCUSSION
The Long Beach Unified School District (LBUSD) and Long Beach Community College District (LBCC) have requested a revision to Long Beach Municipal Code section 10.54.040 to include LBUSD and LBCC among the locations that prohibit skateboarding on their premises. Currently, both Districts have no legal recourse against skateboarders, whose activities result in: numerous calls for service to the Long Beach Police Department; claims against LBUSD as a result of injuries sustained by the skateboarders; and $100,000 spent annually to repair damages caused by skateboarders. Additionally, skateboarders create a safety issue on the LBCC campuses due to the high volume of pedestrian traffic.
 
This matter was reviewed by Deputy City Attorney Gary Anderson on December 29, 2006 and Budget Management Officer David Wodynski on January 5, 2007.
 
TIMING CONSIDERATIONS
City Council action is requested on January 23, 2007 to expedite the ordinance revision.
 
FISCAL IMPACT
There is no direct fiscal impact associated with this municipal code amendment;
however, the Police Department may experience increased calls for service as a result of the expanded enforcement duties associated with this request.
 
SUGGESTED ACTION
Approve recommendation.
