Authorize City Manager to execute amendments to the agreement relative to the extension of the term, to authorize additional services, if required, within the provisions of the agreement, and to adjust the fee schedule of hourly rates for inflation.

DISCUSSION
On November 26, 2002, the City Council authorized the City Manager to execute a consultant agreement with the Gordian Group to implement the City’s new Job Ordered Contracting S ervice (JOC) i n t he a mount of $350,000 for a term of three years ( see Exhibit A). Gordian has provided JOC documentation and software development and testing, contract development, implementation and training, and follow-up technical support through this agreement. In consideration for use of copyrighted documents and software, the City now pays a licensing and technical support fee of I .5 percent of the value of each project. In accordance with the Gordian contract, the fee was initially 5 percent for the first $3 million of projects, and subsequently lowered to 1.5 percent thereafter, where it will remain for all current and future JOC programs. The fees are paid only as the incremental work order projects are awarded.

The JOC program, which utilizes a competitively bid, firm-price master contract, is a comprehensive procurement system designed to help public agencies provide routine construction services faster and at a lower cost than the traditional system of contracting.

As a result of: the continuing requirement for technical support and the use of copyrighted documents and software provided by Gordian to support the JOC program.
