TITLE

DISCUSSION
The restaurant at 70 Atlantic Avenue has undergone a change in ownership and will be renamed the "Margarita Grille" (previously, "Baja Sonora Grille"). The owner requests a new permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. The proposed permit area and a list of furnishings and ac'cessories to be placed in the permit area are shown on the attached Exhibit A. This permit application was reviewed and approved by the Long Beach Fire Department on July 27, 2005.
 
This permit area will include the sidewalk immediately in front of the restaurant and the contiguous sidewalk in front of the Travelodge Hotel pool enclosure (the restaurant occupies part of the Travelodge Hotel building). The owner of the Travelodge Hotel has provided their written consent for the issuance of this permit. The width of the sidewalk at this location is 20 feet and a minimum clearance of 5 feet shall be maintained along the entire frontage of the permit area.
Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.  This permit was prepared by Deputy City Attorney Lisa Peskay Malmsten on September 14, 2005.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A permit processing,fee of $1,062 was deposited to the General Fund (GP) in the Department of Public Works (PW).

Approve recommendation.
