TITLE
Recommendation to receive supporting documentation into the record; conclude the public hearing; find that the area to be vacated is not needed for present or prospective public use; and adopt resolution ordering the vacation of portions of Fourth Street and Elm Avenue adjacent to 395 East Fourth Street.  (District 1)
 
DISCUSSION
The Fourth Street Loft Partners, LLC, developers of the residential project currently being constructed on the block north of Fourth Street and west of Elm Avenue, propose to construct certain architectural features including veneer faCfade and porch steps beyond their existing property line. Because these design features, desired by the Redevelopment Agency, would have been difficult to accommodate on this 52-foot deep building site, it is recommended that the property line along Fourth Street and Elm Avenue be relocated 3 feet nearer to the curbline. The porch steps will extend to the current edge of the sidewalk, which will remain 12 feet wide. The proposed vacation is shown on the attached Exhibit A.
 
On November 15, 2005, the City Council adopted Resolution No. RES-05-0133, declaring its intention to vacate the subject right-of-way, and set December 13, 2005, as the date for the public hearing. A copy of the City Council letter explaining this action is attached as Exhibit B. The proposed resolution was prepared by Deputy City Attorney Lisa Peskay Malmsten on October 10, 2005.
 
 
TIMING CONSIDERATIONS
The date of this public hearing was set by City Council action.
 
FISCAL IMPACT
A vacation processing fee of $1,000 was deposited to the General Fund (GP) in the Department of Public Works (PW).
