TITLE
Recommendation to request City Attorney to prepare an amendment to Long Beach Municipal Code Chapter 14.14 to remove seasonal restrictions on canopy and windbreak structures over permitted public sidewalk dining areas.  (Districts 1,2)
 
DISCUSSION
Section 14.14.050 of the Municipal Code allows canopies over the public sidewalk, in the
downtown area only, as part of a public walkways occupancy permit. Presently, overhead
structures are limited to the period of November 1st through April 30th. Both the Planning
and Building Department and the Fire Department have no objection to eliminating this
seasonal limit and will continue to review and approve plans for these canopies on a case-
by-case basis.
The Promenade area of the downtown is subject to additional Redevelopment Agency
approved master plans and design guidelines that may, in some cases, supercede Chapter
14.14 or impose additional requirements.
This letter was reviewed by Deputy City Attorney Lisa Peskay Malmsten on September 31,
2005.
