TITLE

DISCUSSION
In 2004, a majority of the homeowners along 5429 to 5548 The Toledo filed a petition with the City Engineer to form a Rule 208 assessment district, to fund the undergrounding of the utilities along the street area as shown on Exhibit A. Under Rule 20B the property owners are liable for the costs of the undergrounding work.

On September 21,2004, the Council authorized Southern California Edison (SCE) to prepare a detailed estimate of the costs that would be associated with the proposed undergrounding work (Council letter attached as Exhibit B). SCE has now completed this work. The next step in the district formation process is to prepare an Engineer's Report in accordance with the Municipal
Improvement Act of 1913. This report determines how the cost of the project will be spread to
the individual property owners benefiting from the undergrounding work. Once the report is
complete, balloting of the property owners will be undertaken in accordance with Proposition
218. If 50 percent (based on assessment amount) are in favor of the project, the City Council
may approve the district formation and the undergrounding work will commence. Attached is an
informational brochure on the formation of assessment districts, labeled as Exhibit C.

The City has received a cost proposal from Harris and Associates to prepare the required report. This firm prepared the preliminary work related to the possible formation of this district and is well qualified to prepare the required Engineer's Report.
