TITLE
Recommendation to authorize City Attorney to pay the sum of $110,000 in full settlement of lawsuit entitled Julie Anderson vs. City of Long Beach.

DISCUSSION
Plaintiff, Julie Anderson filed a lawsuit alleging that she was sexually assaulted by a Long Beach Police Officer, Jonathan D'Aoust on September 12, 2002, while on a ride-a-long with that officer. The officer maintained that a sexual encounter did occur with the Plaintiff, although it was consensual. The City subsequently terminated the officer's employment. Under current law, the City is held responsible for the actions of its officers.

Prior to commencement of trial, the City entered into a tentative settlement of $1 10,000.00. The proposed settlement was presented to the Economic Development and Finance Committee on October 17, 2005 and was approved on that date. We therefore ask authority to pay the sum of $1 10,000.00 in full settlement of this claim against the City of Long Beach.

SUGGESTED ACTION
Approve recommendation.

Respectfully Submitted,
ROBERT E. SHANNON
