TITLE
Recommendation to authorize City Manager to execute permit with Mary Browne for the operation of a sketch portrait concession at Rainbow Harbor. (District 2)

DISCUSSION
Mary Browne has been permitted to operate a sketch portrait concession at the Shoreline Park and Rainbow Esplanade portions of Rainbow Harbor since November 2003. Ms. Browne has a Master of Fine Arts degree, experience as an art instructor, and many years of experience as a commercial sketch artist operating in Long Beach and in Las Vegas.

The proposed permit with Ms. Browne contains the following major provisions:

Use : The permittee will be allowed to operate a sketch portrait concession using equipment such as chairs, an easel , and umbrellas. No permission is granted for permanent fixtures or structures.

Hours of Operation: Scheduled hours of operation shall be pre-approved in writing by the Director of Parks, Recreation and Marine.

Location: The business will be allowed to operate in locations in and around Rainbow Harbor. Operation from other park or beach property administered by the Department will require the prior written approval of the Director of Parks, Recreation and Marine.

Term :Two years, with one, one-year option for renewal at the sole discretion of the City Manager. However, the permit may be revoked at any time with 30 days written notice to the permittee.

Rent: 15 percent of monthly gross receipts. Insurance: The permittee shall provide evidence of insurance as deemed suffcient by the City s Risk Manager.

TIMING CONSIDERATIONS
City Council action is requested on November 1 , 2005, to authorize the execution of the
permit.
