TITLE
Recommendation to authorize City Attorney to pay sum of $6,680 in full settlement of lawsuit entitled Farmers Insurance Exchange vs. City of Long Beach.

DISCUSSION
Claimant's insured was involved in an automobile accident which occurred on
November 13, 2004, on Daisy Avenue at the intersection of Cowles Street. There are no
traffic controls for either direction of traffic on Daisy. The claimant's insured was traveling
southbound on Daisy Avenue at the intersection when he was broadsided by an unmarked
police car traveling westbound on Cowles. The police car stopped at the intersection, but
the officer was inattentive and did not notice the insured going through the intersection.
The insured's vehicle was a 1993 Mercedes Benz which sustained moderate rear side
damage in the amount of $6,680.25.

The proposed settlement was presented to the Economic Development and
Finance Committee on July 5,2005 and was approved on that date. We therefore ask
authority to pay the sum of $6,680.25 in full Settlement of this claim against the City of
Long Beach.
