TITLE
Recommendation to authorize City Manager to execute a First Amendment to Agreement No. 26159 with Long Beach Aquarium of the Pacific to update the maintenance responsibilities for the Wave Fountain located adjacent to the main entry plaza. (District 2)

DISCUSSION
On January 20, 1998, the City Council authorized the City Manager to execute an agreement with the Long Beach Aquarium of the Pacific (Aquarium) whereby the City would assume responsibility for the construction, operation, maintenance and liability of a
water education feature on a portion of the Aquarium leasehold (see Attachment A). The water education feature is also known as the Wave Fountain (Fountain). As part of the effort to increase the attraction of Rainbow Harbor and the Aquarium, in 2004 the
Aquarium requested, and was awarded, grant funding from the Rivers and Mountains Conservancy to renovate the Fountain. The renovations modified the Fountain into an exhibit explaining the natural processes of the watershed and depicting the birth of the
Los Angeles and San Gabriel Rivers flowing from the San Gabriel Mountains to the Pacific Ocean. The renovation improvements included the following:
0 Addition of tile art installed on the Fountain’s exterior granite surface depicting the watershed ;
0 New fiber optic lighting connected within the Fountain’s interior mechanical pump room area; and,
0 New stainless steel box construction to house the fiber optic lighting to illuminate the new watershed interpretation, accommodated by the modification of the existing stainless steel railings. The current agreement does not assign maintenance responsibilities for the improvements outlined above.
