TITLE
Recommendation to authorize a public walkways occupancy permit for sidewalk dining at Legends Restaurant located at 5236 East Second Street. (District 3)
DISCUSSION
Sports Legends, Inc., the operator of Legends restaurant, requested a permit to
temporarily occupy part of the adjoining sidewalk at 5236 East Second Street with portable fixtures for the purpose of sidewalk dining. The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attached Exhibit A. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way. This permit request was reviewed and approved by the Long Beach Fire Department on January 19, 2005. The width of the sidewalk at this location is 13.5 feet and a minimum clearance of 5 feet will be maintained between the permit area and the street tree and parking meter adjacent to the restaurant.
The subject permit was prepared by Deputy City Attorney Lisa Peskay Malmsten on February 23,2005.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
A permit processing fee of $500 was deposited to the General Fund (GP) in the Department of Public Works (PW).
