TITLE

Recommendation to authorize City Attorney to pay the sum of $6,250 as full and final resolution of lawsuit entitled Chrupcala v City of Long Beach, Case No. 13K07823.

DISCUSSION

This lawsuit arises out of a City Water Department mainline pipe rupture causing flooding and resultant damages to plaintiff's property located at 120 East 8th Street.

In light of the probable liability and the extent of the damages, plaintiff agreed to accept $6,250.00 as full settlement. We opine that this proposed settlement represents the reasonable value of the lawsuit. The Economic Development and Finance Committee approved the proposed settlement on December 3, 2013.

Approve recommendation.
