TITLE
Recommendation to authorize City Manager to amend Agreement No. 31146 with Long Beach Public Library Foundation, through which the Foundation provides services and financial support to the Long Beach Public Library system, to extend the term for an additional five years.  (District 2)

DISCUSSION
The Long Beach Public Library Foundation (Foundation) was created in 1996 as a non-profit corporation to acquire financial support to supplement, but not supplant, funding provided by the General Fund for the Department of Library Services (Library).  When the Foundation was established, a vehicle to accept and invest grant and endowment funds was created to provide support and services for the Library.

Since 1996, the endowment funds have grown from bequests, grants and other private gifts from donors seeking to assist the Foundation in fulfilling its goals of supporting the Library.  The Foundation funds the Family Learning Center program located in the libraries in Long Beach.  The Foundation also provides literacy and education programming and material resources, such as technology as well as books, for the Library.  In addition, the Foundation has applied for grant funding to support other special projects for the Library in coordination with the goals of Library management.

Agreement #31146 was approved by the City Council on December 9, 2008 which allowed the Foundation to raise funds for the Long Beach Public Library through grants and included an extension for a five-year period.  Library is now exercising the five-year renewal option to extend the term through November 30, 2018.  The proposed amendment would broaden the scope to allow the Foundation to take advantage of opportunities for non-monetary donations and resources, including gifts of materials and equipment.

This matter was reviewed by Deputy City Attorney Amy R. Webber on November 14, 2013 and Budget Management Officer Victoria Bell on November 18, 2013.

TIMING CONSIDERATIONS
City Council action is requested at the December 3, 2013 City Council meeting in order to continue to facilitate the handling of material resources, bequests and grants by the Long Beach Public Library Foundation on behalf of the Library.

FISCAL IMPACT
The total amount of money from bequests and grants that the Long Beach Public Library receives would be placed in one of the three separate endowment funds held by the Long Beach Public Library Foundation and referred to as the City Library Endowment Funds.  The money and all interest earned on the Funds, if any, less one percent (1%) would belong to the Library in accordance with State of California law.  The total amount of money that would be received by the Foundation over the next five years for the Library is unknown at this time.  Requests for future budget appropriation increases will be brought to City Council after amounts are known.  Those appropriation increases will be offset by revenue received from the Foundation.  There is no impact to the General Fund and no local job impact associated with this recommendation.
