TITLE
Recommendation to authorize City Manager to execute the Sixteenth Amendment to Historical Site Lease No. 24291 with Rancho Los Alamitos Foundation to provide for the annual management fee for lease year 2013-2014.  (District 3)
 
DISCUSSION
On October 3, 1995, the City Council authorized a Historic Site Lease (Lease) with the Rancho Los Alamitos Foundation (Foundation) to manage, operate, and interpret the City's historical site known as Rancho Los Alamitos Historic Ranch and Gardens (Rancho). As stated in the Lease, the Foundation is responsible for enhancing the educational value of the site through public and community activities, assemblies, and visits. Maintenance responsibilities include: maintenance of gardens, residential and agricultural structures, interiors and furnishings, fixtures, utilities, carpeting, and equipment.
 
In consideration of the Foundation's agreement to manage the educational, historical, and community service aspects of the Rancho, the City pays the Foundation an annual management fee. The annual management fee is budgeted in the Department of Parks, Recreation and Marine (PRM), and approved by the City Council upon its adoption of the City's budget each fiscal year. Therefore, once the budget is adopted for the proceeding fiscal year, PRM annually requests City Council authorization to amend the Lease reflecting the management fee for the corresponding lease year.
 
The proposed management fee for 2013-2014 shall remain at $431,556. A Lease amendment is required to document that there will not be an increase to the proposed management fee this lease year. All other terms and conditions of the Lease shall remain in effect. It should also be noted that as part of the One-Time Expenditures approved during the Budget Adoption process for FY14, the City Council approved $50,000 to assist with the drawings and specifications for Phase 3 of the seismic strengthening of the Ranch House.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on September 18, 2013, and by Budget Management Officer Victoria Bell on September 20, 2013.
 
TIMING CONSIDERATIONS
City Council action is requested on October 15, 2013, in order to authorize the execution of the Sixteenth Amendment to Lease No. 24291.
 
FISCAL IMPACT
Sufficient funds are budgeted for the Rancho' Los Alamitos Foundation's annual management fee of $431,556 in the General Fund (GP) in the Parks, Recreation and Marine Department (PR). In addition, $50,000 was approved in One-Time Expenditures to assist with the drawings and specifications for Phase 3 of the seismic strengthening of the Ranch House. These amounts were approved by the City Council on September 3" 2013, as part of the FY14 Budget Adoption. There is no impact to jobs associated with the recommended action.
