TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at The Spoon N Bistro, located at 649 Long Beach Boulevard.  (District 1)
 
DISCUSSION
Jane Yupor Tee, the owner of The Spoon N Bistro restaurant, has requested a permit to temporarily occupy a part of the adjoining sidewalk at 649 Long Beach Boulevard with portable fixtures for the purpose of sidewalk dining.  A map of the proposed permit area and a list of furnishings and accessories to be placed in the permit area are attached.
 
Due to the restaurant's narrow frontage, the proposed barricaded permit area will extend 10 feet to abut the existing tree well, requiring a detour for pedestrian travel around the permit area and street tree. To achieve a 5-foot minimum clear path along the detoured sidewalk path, the existing bike rack will be relocated upon construction of the barricaded permit area. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way.  
 
This matter was reviewed and approved by the Long Beach Fire Department on April 5, 2013, by Deputy City Attorney Linda Vu on May 29, 2013 and by Budget Management Officer Victoria Bell on June 6, 2013.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A permit processing fee of $575 and a security deposit of $575 were deposited into the General Fund (GP) in the Department of Public Works (PW). Approval of this recommendation will provide continued support to the local economy.
