TITLE
Recommendation to authorize City Manager to execute the First Amendment to Agreement No. 29587 with Concept Marine Associates, a Division of TranSystems Corporation, extending the term to December 31, 2015. (District 3)

DISCUSSION
On December 20, 2005, the City Council authorized the execution of a construction management contract with Concept Marine Associates (CMA), a Division of TranSystems Corporation, for the rebuild of the Alamitos Bay Marina (Attachment). Per the terms of Agreement No. 29587 (Agreement), CMA has been instrumental in providing pre-construction and construction services for Basins 1 and 4, including project management, engineering services, materials testing, and inspection services.

The original contract term is scheduled to expire on December 31, 2013. From 2005 through 2007, CMA provided pre-bid engineering and bid preparation services resulting in the issuance of a design-build Request for Proposal in October 2007. The City of Long Beach broke ground on Phase 1 of the project on September 17, 2011. Basin 4 was completed in May 2012 and Basin 1 (Phase 2) will be completed by August 31, 2013. In order to continue with the rehabilitation of the Alamitos Bay Marina, authorization is requested to extend the term of the Agreement to December 31, 2015. The additional 24 months will allow ample time to complete the post-construction requirements, such as preparation of the final “as-built” construction drawings. Additional funding is not necessary for this extension.

The following reflects the changes to the major provisions of the proposed amendment:

§ Term: The term of the Agreement shall be extended to December 31, 2015, and shall remain in place unless the Alamitos Bay Marina rebuild project is completed prior to that date.

All other provisions of CMA’s Agreement No. 29587 will remain the same.
