TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at The Stave restaurant, located at 170 Promenade North.  (District 2)
 
DISCUSSION
The Stave, Inc., the operator of The Stave restaurant, has requested a permit to temporarily occupy a part of the adjoining sidewalk at 170 Promenade North, with portable fixtures for the purpose of sidewalk dining.  A map of the proposed permit area and a list of furnishings and accessories to be placed in the permit area are attached.
 
There are no street fixtures adjacent to the proposed permit area to reduce the remaining Promenade right-of-way to less than the required 5-foot minimum clear passage. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way.  
 
This matter was reviewed by Deputy City Attorney Linda Trang and by Budget Management Officer Victoria Bell on August 27, 2012.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on September 18, 2012, to accommodate the applicant's construction plans.
 
FISCAL IMPACT
A permit processing fee of $2,164 was deposited into the General Fund (GP) in the Department of Public Works (PW).  There is no local job impact associated with the recommendation.
 
SUGGESTED ACTION
Approve recommendation.
