TITLE
Recommendation to authorize City Manager to execute a License Agreement between the City of Long Beach and Southern California Edison for use of certain telephone/power poles located on City property for a ten-year term unless either party, at any time, elects to terminate the Agreement with a 60 day written notice to the other party.  (District 1)
 
DISCUSSION
The City of Long Beach, acting in its capacity as Unit Operator in the Wilmington Oil Field, operates certain telephone/power poles for use in the oil field.  Southern California Edison (SCE) has requested, at its own risk and cost, to also use the poles for the purpose of installing, operating, and maintaining a fiber optic cable.  SCE is installing four new electric substations specifically to provide additional electricity for the Port of Long Beach's clean air program known as cold ironing.  The fiber optic cables on the poles will be utilized by SCE to monitor the performance of the new substations.  
 
This matter was reviewed by Deputy City Attorney Richard F. Anthony on August 13, 2012 and by Budget Management Officer Victoria Bell on August 17, 2012.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
There is no fiscal impact or local job impact associated with this action.
