DISCUSSION
On February 23, 2012, Lyon Communities (Applicant) submitted an application for Conceptual Site Plan Review and paid Conceptual Site Plan Review application fees totaling $12,396 for a proposed mixed use project consisting of 171 dwelling units and a 10,000-square-foot retail building for the property located at 6701 East Pacific Coast Highway. The application was deemed incomplete and the Applicant was advised of the items necessary to deem the application complete. On May 21, 2012, the Applicant formally requested a withdrawal of their application and reimbursement of the application fees. On June 5, 2012, the Department of Development Services notified the Applicant that the City will issue a refund for the application withdrawal in the amount of 85 percent of the application fee pursuant to the Department of Development Services’ refund policy and Section 21.21.701 of the Long Beach Municipal Code.

In accordance with Long Beach Municipal Code, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, an approval to process the refund is requested on behalf of the Applicant.

This matter was reviewed by Assistant City Attorney Michael Mais on June 26, 2012 and by Budget Management Officer Victoria Bell on June 29, 2012.

TIMING CONSIDERATIONS
City Council action is requested on July 24, 2012, to expedite processing of the refund.

FISCAL IMPACT
The amount of $10,537 will be refunded from the Development Services Fund (SR 137). There will be no impact to the General Fund and no local job impact as a result of the recommended action.

SUGGESTED ACTION
Approve recommendation.
