TITLE
Recommendation to authorize City Manager to execute an Indemnity and Hold Harmless Agreement and any related documents with the Long Beach Area Council of the Boy Scouts of America, to allow the City of Long Beach to use the swimming pool at the Will J Reid Scout Camp, located at 4747 Daisy Avenue, beginning on July 14, 2012 and ending on August 23, 2012. (District 8)

DISCUSSION
The Department of Parks, Recreation and Marine (PRM) currently manages three municipal swimming pools: Belmont Plaza Pool, Martin Luther King, Jr. Pool, and Silverado Pool, and uses Jordan High School Pool in the summer in north Long Beach. Last summer, in addition to the use of the Jordan High School Pool, PRM was able to supplement recreational swimming opportunities in north Long Beach through the use of the swimming pool at the Will J Reid Scout Camp, located at 4747 Daisy Avenue (Will J Reid Swimming Pool), which is owned by the Long Beach Area Council of the Boy Scouts of America (Boy Scouts) for a one-time cost of $9,500. This amount is approximately equivalent to the amount that would normally be expended by the Boy Scouts for staff, facility wear and tear, and necessary maintenance for the proposed period of use. This summer, the Boy Scouts have again agreed to allow PRM to use the Will J Reid Swimming Pool at the same one-time cost, along with an Indemnity and Hold Harmless Agreement, which has been approved by the City’s Risk Manager.

This matter was reviewed by Deputy City Attorney Gary J. Anderson on July 2, 2012, and Budget Management Officer Victoria Bell on June 3, 2012.

TIMING CONSIDERATIONS
City Council action is requested on July 10, 2012, in order to enable the execution of an Indemnity and Hold Harmless Agreement, which will allow the City to begin providing recreational swimming at the Will J Reid Scout Camp beginning on July 14, 2012.
