TITLE
Recommendation to authorize City Manager to execute any and all agreements necessary between the City of Long Beach, as Unit Operator of the West Wilmington oil operations, and the Alameda Corridor Transportation Authority, providing for payment of all relocation costs for oil facilities impacted by the Schuyler Heim Bridge Project. (District 1)

DISCUSSION
The Alameda Corridor Transportation Authority (ACTA), acting as a Caltrans Local Agency through a Cooperative Agreement (No. 07-4872) with the State of California, is coordinating the utility relocation of facilities in conflict with the Schuyler Heim Bridge Project. The existing lift bridge spanning the Cerritos Channel will be replaced with a fixed bridge due to seismic concerns, maintenance costs, and unfavorable lane configurations. Consequently, ACTA has agreed to enter into Agreements with the City of Long Beach, as Unit Operator of the West Wilmington oil operations. ACTA will fully reimburse the City and its Field Contractor, Tidelands Oil Production Company, for all costs associated with the relocation of oil field utility and pipeline facilities impacted by the Bridge Project.

The Agreements with ACTA will stipulate the terms by which advance payment for engineering design and subsequent payments for material procurement, construction and demolition, and overhead costs will be made. Additional terms will cover notices, documentation, cost and work scope revisions, insurance, and miscellaneous requirements acceptable to both parties. The Agreements may have an effective date of June 1, 2012, to cover the costs of any preliminary cost estimations made for inclusion in the execution copies.

These matters were reviewed by Assistant City Attorney J. Charles Parkin and by Budget Management Officer Victoria Bell on May 24, 2012.

TIMING CONSIDERATIONS
City Council action is requested on June 12, 2012, so that work may commence in earnest to meet the tight project schedule.
