TITLE

(SVI Trucks), of Loveland, CO (not an MBE, WBE, SBE or Local), for the purchase of one fire service apparatus, under Houston-Galveston Area Council Buy (HGACBuy) Program Contract No. FS12-11 Category DDD05, in a total amount not to exceed $856,938, inclusive of tax and fees.  (Citywide)
 
DISCUSSION
City Council approval is being requested to adopt a Resolution and authorize the City Manager to execute a contract with SVI Trucks for the purchase of one Fire Service Apparatus, for the Long Beach Fire Department (LBFD).  The Fire Service Apparatus is a hazardous materials response vehicle.  The purchase of this vehicle will enable LBFD to enhance its capabilities to respond to incidents involving hazardous materials, Weapons of Mass Destruction (WMD), and chemical, biological, radiological, nuclear, and explosive (CBRNE) agents in the Port of Long Beach (POLB) and throughout the City because it carries numerous meters and devices that can detect hazardous materials/WMD/CBRNE agents.  In addition, the vehicle provides an interior working platform with technologically advanced equipment to assist in the command and control of such an incident.  This vehicle will also provide the capability for Hazardous Materials Specialists to begin identifying and providing technical expertise for successful mitigation and rescue, as they are en route to emergency incidents.  
 
The Department of Public Works, Fleet Services Bureau, investigated procurement   options and learned that HGACBuy completed a competitive bid process under Invitation No. FS-12-11 issued on June 30, 2011 for a fire apparatus and has a contract with SVI Trucks.  The Fleet Services Bureau, with the collaboration of the Department of Financial Management's Purchasing Division and LBFD, is requesting approval to use the HGACBuy Cooperative Purchasing Program, as approved by the City Council on January 24, 2012, and to purchase from the awarded Contract No. FS-12-11 Product Code DDD05.
 
SVI Trucks, A Division of Super Vacuum Mfg. Co., Inc., has agreed to sell the City one Fire Service Apparatus, per quote dated February 9, 2012, under HGACBuy Contract No. FS-12-11.
 
The City Charter Section 1802 provides an alternative procurement method by permitting the City to purchase or otherwise obtain services, supplies, materials, equipment and labor with other governmental agencies by purchasing under their contracts on a voluntary and selective basis when authorized by a Resolution of the City Council.
 
This matter was reviewed by Deputy City Attorney Amy R. Webber on February 13, 2012 and Budget Management Officer Victoria Bell on February 10, 2012.
 
TIMING CONSIDERATIONS
City Council action to adopt the attached Resolution and to approve this purchase concurrently is requested on March 6, 2012 to ensure that the equipment is purchased in a timely manner.  It is important to note that the grant funding from the California Emergency Management Agency's (CalEMA) California Port and Maritime Security Grant Programs (CPMSGP), authorized by Proposition 1B grant equivalent to 25 percent of the total cost, will be lost if the purchase transaction is not completed on or before the expiration date of April 1, 2012.  The balance of 75 percent will be funded by the Port Security Grant Program 2008 (PSGP 08).
 
FISCAL IMPACT
The cost of this contract, an amount not to exceed $856,938, is currently budgeted in the General Grants Fund (SR 120) in the Long Beach Fire Department (FD).  The Port Security Grant Program 2008 requires a 25 percent match from the City of Long Beach, which is being provided by the Port of Long Beach (POLB).  The POLB has received an approval from CalEMA for this 25 percent match to be a project under the POLB's CPMSGP Proposition 1B grant. All contract costs will be offset by grant funds. Non-routine maintenance costs will be covered by the manufacturer's warranty.  Costs incurred beyond the warranty period will be covered by the PSGP grant year 2011. Routine maintenance and fuel will be reimbursed through the LBFD's annual Memorandum of Understanding with the POLB for fire and emergency services.  Future replacement of the equipment may become necessary and if, at that time, it is determined prudent to replace the equipment, the City will seek grant funds for that purpose.  There will be no net impact to either the General Fund (GP) or the Tidelands Operations Fund (TF-401) as a result of the purchase of this Fire Service Apparatus, nor from the personnel that will staff the vehicle once it is put into service.  (TF 401).  There is no local job impact associated with the recommended action.
