DISCUSSION
City Council approval is requested to enter into a contract with Moose Boats, Inc., for the purchase of one 44-foot Tactical Emergency Response Vessel (TERV) and one 35-foot critical incident response/patrol boat. The purchase of these vessels will enable the Long Beach Police Department (LBPD) to gain heightened port and maritime emergency response capabilities and security.
 
An Area Maritime Security Committee analysis conducted in 2008 indicated that enhanced tactical operations and emergency response capabilities are needed in order to enhance the response times related to threats from a variety of levels within the Port of Long Beach (POLB) and the Port of Los Angeles (POLA).  The requested purchase of the TERV and critical incident response/patrol boats will help mitigate any response delays. The TERV is larger than other vessels in the fleet and is designed to be a waterborne Command Post Vessel that can also support the mission of the United States Coast Guard and Customs and the Border Protection Agency to secure the POLB and POLA, and help respond to threats in coastal waterways.  Both vessels will augment existing resources, increase port security and reduce maintenance cost on the current fleet.
 
City Charter Section 1802 provides an alternative procurement method by permitting the City to purchase or otherwise obtain services, supplies, materials, equipment and labor with other governmental agencies by purchasing under their contracts on a voluntary and selective basis, when authorized by a Resolution of the City Council. The Department of Public Works, Fleet Services Bureau, investigated various procurement options and, with the collaboration of the LBPD and the Department of Financial Management Purchasing Division, is recommending to use the GSA Cooperative Purchasing Program and to purchase from a contract awarded under the GSA Federal Supply Schedule 84. GSA enters into contracts with commercial firms to provide supplies and services at stated prices for given periods of time and allows state and local governments to purchase a variety of commercial products and services under specific GSA Schedule contracts to save time and money, and to meet their needs and missions.
 
GSA Schedule contracts are negotiated with the intent of achieving fair and reasonable pricing. It is the City's responsibility to determine that the offer is the best value at the lowest overall cost. Orders placed against GSA Schedules meet the requirement for full and open competition in accordance with Federal Acquisition Regulation (FAR) 8.4.  LBPD has done research and analysis in determining this recommended purchase is the best value at the lowest overall cost.
 
Moose Boats, Inc., has agreed to sell the City one 44-foot TERV and one 35-foot critical incident response/patrol boat, per quote dated December 9, 2011, under GSA Contract No. GS-07F-0507M. Moose Boats, Inc., has offered the City a significant discount on certain equipment versus the current published GSA catalog price.
 
This matter was reviewed by Deputy City Attorney Amy R. Webber on December 23, 2011 and Budget Management Officer Victoria Bell on January 3, 2012.
 
TIMING CONSIDERATIONS
City Council action to adopt the attached Resolution and to approve this purchase concurrently is requested on January 17, 2012, to ensure that the equipment is purchased in a timely manner.  It is important to note that the grant funding from the California Emergency Management Agency's (CalEMA) California Port and Maritime Security Grant Programs (CPMSGP) authorized by Proposition 1B, equivalent to 25 percent of the total cost, will be lost if the purchase transaction is not completed on or before the expiration date of April 1, 2012.  The balance of 75 percent will be funded by the Port Security Grant Program 2008 (PSGP 08).
 
FISCAL IMPACT
The contract is for an amount not to exceed $1,557,539, with 75 percent of the cost currently budgeted in the General Grants Fund (SR 120) in the Police Department (PD).  The Port Security Grant Program 2008 requires a 25 percent match from the City, which will be provided by the POLB California Port and Maritime Security Grant Program (CPMSGP) Prop 1B Grant.  Non-routine maintenance costs will be covered by manufacturer's warranty through May 2013, and will later be funded by the Port Security Grant Program 2011 through May 2016. Routine maintenance and fuel will be reimbursed through the LBPD's annual security MOU with the POLB. Future replacement of the equipment may become necessary and if, at that time, it is determined prudent to replace the equipment, the City will seek grant funds for that purpose. There will be no net impact to the Tidelands Operations Fund (TF 401). There is no local job impact associated with this recommendation.
