TITLE

DISCUSSION
City Council approval is being requested to authorize the City Manager to execute a contract with LDV, Inc., for the purchase of one Mobile Maritime Emergency Operation Center (MMEOC) (Attachment A). This vehicle will utilize existing Los Angeles Regional Common Operating Picture Platform assets, video streaming, and Global Positioning System (GPS) capabilities, Long Beach Common Operating Picture monitoring, air support downlink video and Port of Long Beach (POLB) and Port of Los Angeles (POLA) video monitoring technologies. With this purchase and the technology it will bring to Long Beach, the Long Beach Police Department (LBPD) will gain heightened port and maritime awareness, added support to threat assessments and intelligence gathering capabilities, and provide disaster management assistance within the Incident Command System structure.
 
An Area Maritime Security Committee analysis conducted in 2008 indicated that enhanced tactical operations and emergency response capabilities are needed in order to mitigate the protection and response related to threats from a variety of levels within the Ports of Long Beach and Los Angeles. The requested purchase of a MMEOC will help meet this demand.  In addition, the MMEOC will have interoperability with POLB and POLA through the POLB Joint Command and Control Center and Los Angeles Port Police operation centers.
 
The Department of Public Works, Fleet Services Bureau, investigated procurement   options and learned that the Los Angeles County Sheriff's Department completed a competitive bid process in January 2010 for a similar Emergency Operation Center and has awarded the contract to LDV, Inc., of Burlington, WI.  It was determined by staff that the terms and conditions of this bid would meet the needs of the Department of Public Works, Fleet Services Bureau, and the LBPD.
 
The City Charter provides an alternative procurement method by permitting the City to purchase or otherwise obtain services, supplies, materials, equipment and labor with other governmental agencies by purchasing under their contracts on a voluntary and selective basis when authorized by a Resolution of the City Council.
 
LDV, Inc., has agreed to sell the City one MMEOC, per quote dated August 15, 2011, on the same terms and conditions afforded to the Los Angeles County Sheriff's Department under Bid No. RFB-IS-10200542-1.
 
This matter was reviewed by Deputy City Attorney Amy R. Webber on December 7, 2011 and Acting Budget and Performance Management Bureau Manager Shari Metcalfe on December 9, 2011.
 
TIMING CONSIDERATIONS
City Council action to approve this purchase is requested on January 17, 2012, to ensure that the equipment is purchased in a timely manner.  It is important to note that the grant funding from the California Emergency Management Agency's (CalEMA) California Port and Maritime Security Grant Programs (CPMSGP), authorized by Proposition 1B grant equivalent to 25 percent of the total cost, will be lost if the purchase transaction is not completed on or before the expiration date of April 1, 2012.  The balance of 75 percent will be funded by the Port Security Grant Program 2008 (PSGP 08).
 
FISCAL IMPACT
The cost of this contract, in an amount not to exceed $706,027, is currently budgeted in the General Grants Fund (SR 120) in the Long Beach Police Department (PD).  The Port Security Grant Program 2008 requires a 25 percent match from the City of Long Beach, which is being provided by the Port of Long Beach. The Port has received approval from CalEMA for this 25 percent match to be a project under the Port's CPMSGP Proposition 1B grant.  Costs for training on the MMEOC have been built into the cost of the equipment and will be provided by the vendor.  Maintenance costs, which are anticipated to be minimal, will be covered by manufacturer's warranty and grant funds through May 2016.  The City will seek to acquire additional grant funds for maintenance beyond 2016.  Future replacement of the equipment may become necessary and if, at that time, it is determined prudent to replace the equipment, the City will seek grant funds for that purpose. There will be no impact to the General Fund.  There is no local job impact associated with the recommended action.
