TITLE
Recommendation to authorize City Attorney to pay sum of $10,849.04 in full settlement of lawsuit entitled Interinsurance Exchange for the Automobile Club.

DISCUSSION
A Gas Department employee failed to stop for a red light causing a second vehicle to swerve to avoid collision and, in so doing, collided with a third vehicle.  Based on several witness statements, it is likely the City and its employee will be found liable for the accident for violation of CVC 21453 (circular red).

The Claimant's insured vehicle was totaled. The Interinsurance Exchange for the Automobile Club seeks reimbursement for property damage in the amount of $10,849.04.

The proposed settlement was presented to the Economic Development and Finance Committee on December 6,2011 and was approved on that date. We therefore ask authority to pay the sum of $10,849.04 in full settlement of this claim against the City of Long Beach.

SUGGESTED ACTION
Approve recommendation.

Respectfully Submitted,

ROBERT E. SHANNON
CITY ATTORNEY
