TITLE

DISCUSSION
In 2002, California voters passed the Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002, also known as Proposition 40. The Department of Parks, Recreation and Marine (PRM) successfully applied for, and received, several grants under the following Proposition 40 grant programs: Roberti-Z’Berg Harris, Per Capita and Murray Hayden. With the exception of the Rancho Los Cerritos Visitors Center and the McBride Teen Center, all of the grants associated with Proposition 40 have been completed.

In 2008, all Proposition 40 grant funding was suspended by the State of California (the State) for a period of time due to budget issues. As a result, many projects were delayed. The State subsequently approved the extension of all remaining Proposition 40 projects through recent legislative action. However, the State has revised their standard grant contract language, which now requires all grant contracts to include a deed restriction, thereby necessitating approval by the City Council of the new replacement grant contracts. In the case of Rancho Los Cerritos, the deed restriction requires that the Visitor’s Center remain in place on the property for the term of the restriction (20 years). The same restriction is required for the McBride Teen Center.

This matter was reviewed by Deputy City Attorney Gary J. Anderson on December 7, 2011, and Acting Budget and Performance Management Bureau Manager Shari Metcalfe on December 8, 2011.
