TITLE

Recommendation to authorize City Attorney to pay the sum of $200,000 in full settlement of lawsuits entitled Tavaron Mitchell v. City of Long Beach, et al., and Marcus Toles v. City of Long Beach, et al.

DISCUSSION

On May 31, 2008, plaintiffs were shot by LBPD officers responding to a silent burglary alarm at the nix Check Cashing store near Anaheim Street and Obispo Avenue.  Mitchell is paralyzed as a result of the shooting; Toles has recovered.  After extensive discussion a tentative global settlement of $200,000 was reached.

The Conomic Development and Finance Committee approve the propsed settlement on December 6, 2011.

SUGGESTED ACTION

Approve recommendation.
