TITLE
Recommendation to request City Council to support re-instating the previously removed language to Assembly Bill 2593 regarding local control of the placement of registered sex-offenders and communicate this to the author of the legislation and our representatives in Sacramento; and request City Manager to work with the Police Department to express similar support.
DISCUSSION
During the last week of May 2008 an Assembly Committee gutted an important part of AB 2593 - a bill to limit the number of sex offenders in a residential facility. The vote also prohibited any debate on the bill. According to LBReport.com, the official position from the Speaker of the Assembly on why this was done was because "law enforcement did not support the amendments."
The key provisions that were gutted from the bill removed the ability to for a City or County to adopt a local ordinance to include a residential facility that serves six or fewer persons, including a sober living facility, within the definition of 'single family dwelling.'
In light of recent conversations the City Council has had with regards to regulating the placement of registered sex-offenders, it is important for the Council and the Police Department to signal support for AB 2593.
