DISCUSSION
JMB 516, Inc., the operator of the Shore House Cafe, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. The Shore House Cafe, Inc., the previous owner, had a permit for sidewalk dining at this location from June 2002 to June 2006. The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attached Exhibit A.
 
Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary use of public right-of-way. The width of the public sidewalk at this location is 13.5 feet. A minimum clearance of 9 feet shall be maintained between the proposed permit area and the curbface along Second Street.
 
This permit request was reviewed and approved by the Long Beach Fire Department on August 29, 2006. The subject permit was prepared by De'puty City Attorney Lisa Peskay Malmsten September 28, 2006.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A permit-processing fee of $500 was deposited to the General Fund (GP) in the Department of Public Works (PW).
