TITLE
Recommendation to authorize City Manager, or designee, to execute a Public Walkways Occupancy Permit for sidewalk dining at Starling Diner restaurant, located at 4114 East 3rd Street. (District 3)

DISCUSSION
The operator of Starling Diner restaurant, located at 4114 East 3rd Street, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. The proposed permit area and the list of furnishings to be placed in the permit area are shown on Exhibit A. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.

The width of the sidewalk at this location is 12 feet. A minimum clearance of 6 feet will be maintained along the sidewalk adjacent to the curbside permit area barricade and the private property line. In addition, a sidewalk dining area is proposed adjacent to the building, to which the 2-feet on private property will not be counted as part of the Public Walkways Occupancy Permit (PWOP) and the approximately 1-foot of dining area that extends onto the public sidewalk area will be counted as part of the PWOP square footage. The curbside PWOP area will be subject to 8:00 a.m. to 3:00 p.m. hours of operation, after which the portable private furnishing and temporary sturdy barricade shall be removed and stored on private property.

TIMING CONSIDERATIONS
City Council action on this matter is not time critical.

FISCAL IMPACT
