TITLE
Recommendation to authorize Department of Development Services to process a refund in the amount of $12,797 to Cobalt Construction Company, for the property located at 200 East Anaheim Street. (District 1)
DISCUSSION
Cobalt Construction Company (Cobalt) is the general contractor for a senior apartment development located at 200 East Anaheim. On December 4, 2012, Cobalt paid $15,662 to have a temporary release of the electrical utilities in order to test building equipment prior to occupancy. Inadvertently, Cobalt was charged an incorrect fee due to a system error for the temporary utility release permit and is now owed a refund of $12,797.
In accordance with Long Beach Municipal Code, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, an approval to process the refund is requested on behalf of the applicant.
This matter was reviewed by Deputy City Attorney Richard Anthony on December 10, 2012 and Budget Management Officer Victoria Bell on December 17, 2012.
TIMING CONSIDERATIONS
City Council action is requested on January 8, 2013, to expedite processing of the refund.
FISCAL IMPACT
The amount of $12,797 will be refunded from the Development Services Fund (SR 137). There is no local job impact as a result of this recommended action.
