TITLE
Recommendation to authorize Department of Development Services to process a refund in the amount of $10,240 to Elyse Avila for the property located at 5000 East 2nd Street. (District 3)
DISCUSSION
On January 6, 2014, Elyse Avila (Applicant) paid fees totaling $10,240 for a Major Conditional Use Permit request to allow the sale of beer, wine and distilled spirits for a restaurant located at 5000 East 2nd Street. The Applicant withdrew this request due to factors outside of the City's control. In accordance with Long Beach Municipal Code (LBMC) Section 3.48.030, the Applicant is eligible for a 100 percent refund, or $10,240.
In accordance with LBMC, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, authorization to process the refund is requested on behalf of the Applicant.
This matter was reviewed by Deputy City Attorney Kendra Carney on August 22,2014, and by Budget Management Officer Victoria Bell on August 26,2014.
TIMING CONSIDERATIONS
City Council action is requested on September 16, 2014, to expedite processing of the refund.
FISCAL IMPACT
The amount of $10,240 will be refunded from the Development Services Fund (EF 337). There will be no local job impact as a result of the recommended action.
