TITLE
Recommendation to authorize City Manager, or designee, to execute a Public Walkways Occupancy Permit for sidewalk dining at Dog Haus, located at 210 East 3rd Street, Suite D. (District 2)
DISCUSSION
The operator of Dog Haus, located at 210 East 3rd Street, Suite D, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. The proposed permit area and the list of furnishings and accessories to be placed in the permit area are shown on Exhibit A. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.
The building owner completed a Public Walkways Occupancy Permit in anticipation of a future tenant on October 2, 2014, but it was not used. Dog Haus opened in 2016 and has since applied for a Public Walkways Occupancy Permit for sidewalk dining.
The proposed sidewalk dining area is located within the right-of-way along the east side of the 80-foot wide Promenade. A central clear path greater than 20 feet will be maintained within the remaining right-of-way, adjacent to the permit area.
This matter was reviewed by the Department of Development Services Building and Safety Bureau on October 12, 2017, by Deputy City Attorney Linda T. Vu
on November 9, 2017, and by Budget Analysis Officer Julissa José-Murray on November 13, 2017.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
A permit processing fee of $1,071 was deposited in the General Fund (GF) in the Public Works Department (PW), and a security deposit of $1,008 was collected to ensure sidewalk repairs upon permit termination. Approval of this recommendation will provide continued support to the local economy.
