DISCUSSION
On August 19, 2003, the City Council adopted a Proposition "L" Ordinance and awarded a contract to furnish and deliver tree trimming services to California Western Arborists, Inc., in the amount of $553,919 (see Attachment). Due to favorable bids from this contractor the award amount was approximately $150,000 less than the budgeted amount.
 
The contractor has made excellent progress and will complete all tree trimming work early this summer. Based on an early completion date and the contractor's performance, staff is requesting a contract amendment to include the remaining $150,000 in budgeted funds to trim a backlog of trees, primarily palm trees. The contractor has agreed to do this additional work at the unit prices quoted at the time of award.
 
The City has a large backlog of palm trees that need to be trimmed. Due to prior year budgetary constraints, palm trees, which should be trimmed every two years, were put on a four-year cycle. The resulting overgrowth has become very evident, as seen recently by the number of palm fronds deposited on City streets after a heavy storm or wind.
 
This matter was reviewed by Deputy City Attorney Donna F. Gwin on March 25, 2004, and Budget Manager Michael Killebrew on April 6, 2004.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on May 4, 2004, to authorize commencement of the additional tree trimming work.
 
FISCAL IMPACT
Sufficient funds for this contract amendment are budgeted in General Fund (GP) in the Department of Public Works (PW).
 
IT IS RECOMMENDED THAT THE CITY COUNCIL:
 
Authorize the City Manager to execute the First Amendment to contract No. 28391 with California Western Arborists, Inc., in the amount of $150,000 to furnish and deliver tree trimming services.
