TITLE

Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at Beer Belly restaurant, located at 255 Long Beach Boulevard.  (District 2)

DISCUSSION

The operator of Beer Belly restaurant, located at 255 Long Beach Boulevard, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining.  The proposed permit area and the list of furnishings to be placed in the permit area are shown on the attachment.  Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.

The width of the sidewalk at this location is 15 feet.  A minimum clearance along the sidewalk adjacent to the permit area will vary from 9 feet between the barricade and curb, and 7.5 feet between the street tree and barricade.

This matter was reviewed by the Development Services Building and Safety Bureau on February 5, 2016, by Deputy City Attorney Linda T. Vu on February 17, 2016, and by Revenue Management Officer Julissa José-Murray on May 24, 2016.

TIMING CONSIDERATIONS

City Council action on this matter is not time critical.

FISCAL IMPACT

A permit processing fee of $616 was deposited into the General Fund (GF) in the Public Works Department (PW), and a security deposit of $580 was collected to ensure sidewalk repairs upon permit termination.  Approval of this recommendation will provide continued support to the local economy.
