TITLE
Recommendation to request City Attorney to accept an easement deed for the widening of Liberty Court adjacent to 120 Linden Avenue. (District 2)
DISCUSSION
It is the goal of the Department of Public Works to widen streets and alleys to the standards established in the City's General Plan. When significant new development is proposed, the public rights-of-way adjacent to the site are reviewed for sufficiency to accommodate the new development. For the construction of a 4,900 square-foot hotel at 120 Linden Avenue, the dedication of additional alley width is recommended as follows:
The existing 16-foot wide alley known as Liberty Court should be widened on the west side by 2 feet, to a total width of 18 feet. The standard alley width of 20 feet will be achieved when property on the east side of the alley is improved and a public alley dedication of an additional 2 feet is recorded. The area to be dedicated is shown on the attached Exhibit A.
The developer of the subject property agreed to development conditions that include the above-described dedications and has paved the area to be dedicated.
This matter was reviewed by Deputy City Attorney Lori A. Conway on November 28, 2006. In conformance with the California Environmental Quality Act, Mitigated Negative Declaration No. ND-14-01 was certified for this project.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
A document processing fee of $250 was paid by the developer and deposited in the General Fund (GP) in the Department of Public Works (PW).
