TITLE
Recommendation to authorize City Attorney to accept plaintiff's payment in the sum of $5,000 for impound fees and to remove his boat from the marina within 90 days of the execution of the final settlement documents in full settlement of lawsuit entitled Haile v. City of Long Beach, Case No. NC038113.
DISCUSSION
This lawsuit arises out of plaintiff's vessel being impounded by the Marine Bureau for non-payment of slip fees. In this suit, plaintiff sought recovery of his boat and damages resulting from the impound.
Through a mandatory settlement conference, a tentative agreement was reached where the plaintiff agreed to pay the City $5,000 in overdue fees and removal of his boat from the marine within 90 days, subject to City Council approval.
The Economic Development and Finance Committee approved the proposed settlement on April 3, 2007.
